Buying a warrantied horse from Crack On includes a 14 day assessment or exchange policy. This policy does not apply to privately owned horses sold through Crack On and where Crack On act as agents or to Trade sales or sales where the buyer is buying the horse in the course of business.
Notice of the requirement to return a horse must be made in writing not later than 14 days from the date of purchase (day of cleared funds).
DESCRIPTIONS AND WARRANTIES
Where a horse is described, the descriptions are defined as follows:-
Unbroken – must be quiet to lead and to halter.
Lightly backed/partly broken - must be capable of being ridden by a competent rider at slow paces in an enclosed school.
Green – must be capable of being ridden by a competent rider at slow paces.
Quiet to ride – must be quiet and easy to ride.
Sold as a Hack – quiet to ride and suitable for light work only.
Hunter – has been hunted and is capable of being hunted.
Show jumper – must be able to jump a curse commensurate with capability when ridden by a competent rider.
Riding club horse/ Pony Club pony – must be capable of basic activities when ridden by a competent rider i.e. unaffiliated novice dressage, SJ, XC, tack and turn our classes.
Potential – when described as having potential, the horse must have capabilities and be examined as such by a specialist equine veterinary surgeon.
Broodmare/companion – no warranty is given as to a broodmare or companion except in relation to vices.
Show horse/pony – must have a proven show record but cannot be warranted as such except for vices.
Children’s ponies – are warranted suitable for children of ages/heights as stated in the current Ponies (UK) current yearbook – i.e. a child under the age of 10 years old should be on a lead rein.
It is essential that buyers satisfy themselves that the horse is exactly what they are looking for prior to sale and instructors/advisors/trainers/vets are therefore very welcome to attend all trials.
DEPOSIT
A horse will be held upon receipt of a 10% deposit (10% of the purchase price). Deposits are non-refundable.
PAYMENT
Horses must be paid for within 4 working days of the deposit being paid and funds must be cleared prior to collection or delivery. Payment by cash (which can be paid directly into our bank account) or by direct telephone transfer only.
In the event that the buyer fails to pay the balance of the purchase price within 4 days of payment of the deposit monies, the horse will be re-advertised for sale. The deposit is non-refundable.
HOLDING A HORSE FOR YOU AFTER PURCHASE
Where you require us to hold a horse for you, we will do this upon full payment of the purchase price. After week one, we will charge livery at £100.00 per week plus the costs of shoeing and any veterinary fees.
DELIVERY
The buyer may arrange for the transportation of the horse from our premises at their own expense. Alternatively, Crack On will arrange for the Horse to be transported to the buyer’s premises, at the buyer’s expense.
Upon receipt of the purchase price (as cleared funds):-
- The ownership of the horse shall pass to the buyer. Crack On strongly recommend that the buyer adequately insures the horse (preferably covering third party liability, death, theft, veterinary fees and loss of use) prior to or immediately upon payment of the purchase price;
- risk of death, loss or injury to the horse shall pass to the buyer, for which reason Crack On recommend that the buyer immediately insures the horse upon or prior to paying the purchase price to Crack On;
- responsibility for any loss, damage or injury howsoever caused by the horse shall pass to the buyer;
- Crack On will release possession of the horse to the buyer or his/her employee/agent together with all original documents (studbook, passport, vaccination card, etc.); and
Any loss, damage or injury howsoever caused by the horse whilst the horse is at Crack On awaiting collection by the buyer shall be the buyer’s responsibility.
VETERINARY INSPECTION
All horses are open to veterinary inspection and buyers are encouraged to have horses inspected by a veterinary surgeon prior to purchase.
Where a buyer wishes to purchase a horse subject to veterinary examination, such examination must take place within 4 days of the date of the deposit monies being paid.
Where the veterinary surgeon confirms that the horse is suitable for the purpose stated/described, the buyer will pay the balance of the purchase price to Crack On within 2 working days of the veterinary examination.
Where a horse has been examined by a veterinary surgeon, the buyer cannot thereafter complain to Crack On about matters which should have been covered by the veterinary examination.
WARRANTY
If the horse is not suitable for the buyer, the buyer must write to Crack On through the postal service (at the address given above) not later that 14 days after the date of Sale Agreement. This important document must be sent recorded delivery to us.
Crack On do not provide an email service for our exchange policy.
Crack On will ask that you complete a questionnaire detailing the problems you are experiencing with the horse and will take delivery of the horse (at the buyer’s expense) at their premises for assessment. The costs of assessment will be paid by Crack On.
Once the horse has been assessed, if Crack On are satisfied that the horse is fit for purpose and as described, they will further train the horse (at their own cost) where necessary or where this is inappropriate, will offer a replacement horse.
Horses may not be returned to Crack On later than 14 days from the date of the Sale Agreement. Where a horse is returned, it must be in the same or better condition than it was in at the date of purchase and where the horse is being returned as a result of a physical or health problem, (where the horse was not vetted prior to purchase) must be returned with a veterinary certificate or report from a specialist equine veterinarian confirming that the problem was present prior to and at the date of purchase.
Where an exchange horse is offered during the 14 day warranty period, Crack On will exchange the horse for a horse of like type and quality and of like value. Alternatively, Crack On will part-exchange the horse for another horse where if that horse’s value is greater than the horse being returned, the buyer will pay the difference in the purchase price to Crack On. Where the new horse’s value is less than the horse being exchanged, Crack On will refund the difference in the purchase price to the buyer.
Any horse exchange offered must be viewed, tried and assessed by the customer at Crack On's premises. An exchange horse can not be sent or collected unseen.
Crack On will not under any circumstances provide a cash or monetary refund where a horse has been viewed prior to purchase.
All costs associated with returning a horse (e.g. transportation costs, costs of keep and veterinary costs) are the responsibility of the buyer and must be paid in full by the buyer. Crack On reserves the right to charge livery at £100.00 per week plus any costs of shoeing and veterinary fees.
The 14 day assessment or exchange policy does not apply where a buyer has part-exchanged their own horse. Where a buyer has part exchanged their own horse as part payment for a horse from Crack On, in the event that the buyer’s old horse has been sold, it will not be possible for Crack On to return that horse to the buyer. If however the part-exchange horse is still the property of Crack On, and the buyer wishes to purchase that horse back, the horse may be purchased for the sum that the horse was originally part-exchanged for, plus costs of keep whilst he has been in the care of Crack On, training costs, farriery, advertising costs and any veterinary fees.
PRIVATE SALES
Some of our horses are sold on behalf of customers. Where this is applicable, it is clearly stated on the horses description page and wherever possible the description itself is written by the current owner. In this instance we are acting as an agent for the seller and take a 10% commission fee.
